These Terms & Conditions (“Terms”) govern your use of the Recast mobile application and the related services available through recast.atlaskrea.com (collectively, the “Services”).

The Services are provided by Şardağ Bilişim Yazılım Teknoloji Limited (“Şardağ,” “Recast,” “we,” “us,” or “our”).

Please read these Terms and our Privacy Policy carefully. By tapping “I Agree,” generating content, or otherwise using the Services, you agree to these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 16 years old to use Recast.

If the law where you live requires you to be older than 16 to consent to these Terms or to the processing of personal information, you must meet that higher age requirement.

You may not use the Services if doing so is prohibited by applicable law.

2. Description of the Services

Recast uses artificial intelligence and related video-processing technologies to create or edit images and videos from material you provide.

Depending on the feature, you may provide:

• a guided face scan;
• photographs of yourself or another authorized person;
• a full-body or outfit photograph;
• videos selected from your device;
• links to supported third-party video services;
• text prompts or scripts; or
• audio files.

Some features process this material through third-party artificial intelligence and infrastructure providers. Further information is provided in our Privacy Policy.

3. Your Content and Permission to Use It

“Input” means any photograph, face image, video, audio, text, link, prompt, or other material you submit to the Services.

“Output” means an image, video, or other content generated through the Services in response to your Input.

Input and Output are collectively referred to as “Content.”

You represent and warrant that:

• you own your Input or have all permissions and legal rights necessary to use it;
• every identifiable person in your Input has authorized you to use their face, likeness, body, voice, and other personal characteristics for the requested generation;
• your Input and your use of any Output do not violate another person’s privacy, publicity, personality, image, voice, copyright, trademark, or other rights;
• your Content and use of the Services comply with applicable law; and
• the information you provide in connection with a complaint or support request is accurate.

Do not upload another person’s face, likeness, body, or voice unless that person has given you permission or you otherwise have a lawful right to use it.

4. Prohibited Uses

You must not use Recast to create, upload, request, distribute, or share Content that:

• uses another person’s face, likeness, body, or voice without authorization;
• impersonates a celebrity, public figure, private individual, or organization in a deceptive, fraudulent, defamatory, or harmful manner;
• falsely suggests that a person said, did, supported, or endorsed something;
• violates privacy, publicity, personality, intellectual-property, data-protection, or other legal rights;
• contains or promotes child sexual abuse, exploitation, grooming, or sexualization of a minor;
• contains non-consensual sexual content, nudity, pornography, or sexually explicit material;
• promotes violence, self-harm, harassment, bullying, hate speech, or discrimination;
• facilitates fraud, scams, unlawful activity, or threats;
• contains malware or attempts to interfere with the security or operation of the Services;
• attempts to bypass, disable, manipulate, or evade safety or content-moderation systems;
• uses automated tools, scraping, or unauthorized access methods; or
• otherwise violates applicable law or these Terms.

The absence of an automated warning or block does not mean that Content is lawful, authorized, or permitted. You remain responsible for your Content and its use.

5. Responsibility for Generated Content

Artificial intelligence may create inaccurate, unexpected, offensive, incomplete, or visually distorted results.

You are responsible for reviewing each Output before downloading, publishing, distributing, or otherwise using it.

You are solely responsible for:

• the Input you provide;
• deciding whether an Output is appropriate and lawful;
• obtaining all required permissions;
• the context in which you publish or share an Output; and
• any claim, harm, or legal consequence resulting from your Content or your use of an Output.

Outputs must not be treated as factual information or professional medical, legal, financial, safety, or other professional advice.

Where required by law or necessary to prevent deception, you must clearly disclose that an Output was created or altered using artificial intelligence.

6. Ownership and Limited Service License

You retain the rights you lawfully hold in your Input.

To the extent permitted by applicable law, you may use the Output we deliver to you, subject to these Terms and the rights of other people.

We do not grant you any rights in another person’s face, likeness, voice, copyrighted work, trademark, or other protected material merely because the Services produced an Output containing or resembling that material.

You grant us a limited, non-exclusive license to host, copy, transmit, process, modify, and store your Input and Output only as reasonably necessary to:

• operate the Services;
• generate and deliver your requested Output;
• perform safety and compatibility checks;
• troubleshoot failed generation jobs;
• prevent fraud or abuse;
• provide customer support; and
• comply with legal obligations.

This license ends when the relevant Content is deleted, except where continued retention is reasonably required by law, security, dispute resolution, or enforcement obligations.

We do not claim ownership of your Content merely because you use Recast.

7. Third-Party Services

Recast uses third-party service providers to process media and generate results. These may include fal.ai and artificial-intelligence models made available through it, such as Kling, Seedream, MiniMax, and HeyGen, as well as cloud and GPU infrastructure providers.

Your use of Recast does not create a direct consumer account with those providers. However, the processing of your Input may also be subject to their applicable privacy and service terms.

Third-party services may become unavailable, change their capabilities, reject a request, or return an unexpected result. We do not guarantee the continued availability of a particular provider or model.

8. Content Moderation and Enforcement

We may use automated checks, technical restrictions, human review, and user complaints to identify prohibited or unlawful use.

We may, where appropriate:

• refuse or stop a generation request;
• restrict an upload;
• remove or disable access to Content;
• suspend access to a feature;
• preserve information required for an investigation;
• report conduct when legally required; or
• terminate access to the Services.

We are not obligated to monitor every Input or Output. Our failure to detect or block Content does not transfer responsibility for that Content to us.

9. Complaints and Reports

If you believe Content created through Recast infringes your face, likeness, voice, privacy, copyright, trademark, or other legal rights, contact us at:

Please include, where available:

• your name and contact information;
• a description of the right you believe was infringed;
• a description or copy of the relevant Content;
• information that helps us locate the Content or generation;
• confirmation that you are the affected person or are authorized to act for them; and
• a statement that the information in your complaint is accurate.

We may ask for additional information needed to verify and investigate the complaint. We may remove or restrict Content while reviewing a report.

Knowingly submitting a false or abusive complaint may itself violate these Terms.

10. Privacy

Our collection and use of personal information are explained in the Recast Privacy Policy.

Before sending selected photos, videos, audio, prompts, or face images to a third-party generation provider, Recast may ask for your explicit consent. If you decline, the generation features requiring that processing will not be available.

11. Service Availability and Results

The Services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we do not guarantee that:

• every generation will succeed;
• an Output will resemble a particular person;
• an Output will be accurate, unique, uninterrupted, or error-free;
• the Services will always be available;
• processing will finish within an estimated time; or
• Content will never be lost.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Şardağ Bilişim Yazılım Teknoloji Limited and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, or exemplary damages arising from your use of the Services.

This includes loss caused by:

• unauthorized Input;
• publication or sharing of an Output;
• infringement of another person’s rights;
• failed or delayed generation;
• unavailable third-party services; or
• loss or corruption of Content.

Nothing in these Terms limits liability that cannot legally be limited.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Şardağ Bilişim Yazılım Teknoloji Limited and its affiliates, officers, employees, and service providers from claims, losses, liabilities, and reasonable expenses arising from:

• your Content;
• your use or sharing of an Output;
• your violation of these Terms;
• your violation of applicable law; or
• your violation of another person’s rights.

14. Suspension and Termination

You may stop using Recast at any time.

We may suspend or terminate access to the Services if we reasonably believe that you have violated these Terms, created a safety or legal risk, infringed another person’s rights, or misused the Services.

Provisions concerning Content responsibility, ownership, complaints, liability, and disputes survive termination where their nature requires it.

15. Changes to These Terms

We may update these Terms to reflect changes to the Services, providers, law, or safety requirements.

We will update the “Last Updated” date and provide additional notice where required. Material changes apply prospectively after they take effect.

If you do not agree to an updated version, you must stop using the Services.

16. General Provisions

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions remain effective.

Our failure to enforce a provision is not a waiver of that provision.

These Terms and the Privacy Policy constitute the agreement between you and us concerning your use of Recast.

These Terms do not limit any mandatory consumer rights available under applicable law.
